摘要:
第三方网上支付平台既是买家的代理人,也是卖家的代委托人,它接受买卖双方的指令,支付货款与接收货款。第三方网上平台对于用户留在自有账户上的沉淀资金及其孳息的处理,各法律关系主体之间的关联并不明确。应立法规定沉淀资金及孳息的法律权属,明确沉淀资金及其孳息所有权属于用户; 鼓励金融创新,提升资金利用效率; 设立用户风险基金和保险基金,维护用户的合法权益。
Abstract:
The third-party online payment platform is not only the buyer’s agent but also the seller’s trustee; it accepts instructions both from the seller and buyer,pay the price and receive the payment.However,the third party online platform doesn’t know how to treat the precipitation funds and its interests on the user’s own account.In addition,the legal relation between precipitation funds and its interests is not clear.So,we should clear the legal ownership of the precipitation funds and its interests in the law,clear the ownership belongs to the user; encourage financial innovation and improve the efficiency of the use of funds; and set up user risk fund and insurance fund to safeguard the legitimate rights of users.
