摘要:

随着中国利率市场化改革步伐的加快及利率竞争的日益加剧,担保作为最重要的非利率因素,势必将成为金融机构之间竞争的重要要素。担保作为一项重要的融资条件,在间接融资中一直被广泛使用。《担保法》规定的担保方式有保证、抵押、质押、留置、定金。而融资担保是一种普遍、重要的满足项目需求的担保,选择BOT项目融资的资信结构主要由项目的资产收益、合同协议和资信增级措施三个方面构成。作为一种适合基础设施建设的新型融资方式,对亟待发展我国在境外承担其基础设施建设而言,具有特殊的意义。

Abstract:

The quickening pace of China's market-oriented interest rate reform and interest rate competition are intensifying,the guarantee as the most important factors other than interest rates,will become another important element of competition between financial institutions.Also as an important financing guarantee conditions,it has been widely used in the indirect financing.The “Security Law” regulation guarantee has ways of guarantee,mortgage,pledge,lien and deposit.The financing guarantee is a kind of common and important guarantee to meet project requirements,and choosing the creditability of the BOT project financing structure is mainly composed of project assets returns,the contract and credit enhancement measures from three aspects.As a new financing way for infrastructure construction,it is of great importance to the development of our country abroad to undertake infrastructure construction.
